Qesis Belay Mekonnen sentenced to 5 years in prison and a fine of 10,000 birr.

 

The Federal High Court, Lideta Division 3rd Corruption Cases Criminal Court, examined the evidence presented in the case against Qesis Belay Mekonnen and decided to sentence him to imprisonment and a fine in today's hearing.

 

The Public Prosecutor of the Ministry of Justice's Corruption Cases Directorate filed a case against the defendants:

➡️ Qesis Belay Mekonnen, 

➡️ Yasu Alat, who is engaged in agricultural investment, 

➡️ Bereket Mulatu, who is engaged in commission work, and Alemgena Samuel, 

➡️ Abera Merga, the manager of Nimona Trading Company Limited.

 

The defendants were charged with serious fraud and corruption, alleging that the first defendant submitted a total of 6 million 50 thousand dollars to the bank, claiming that the defendants were to be paid in various amounts, despite the fact that no payment order had been issued by the African Union.

 

Only the defendants named 1st to 3rd were brought to trial and served with the list of charges, while the case of the 4th and 5th defendants was temporarily discontinued due to their failure to appear at their addresses and repeated failure to appear for the hearing.

 

The court examined the first-degree objections raised by the defendants named 1st to 3rd, stating that they would be examined in the future with evidence, and rejected their objections.

 

After the defendants had denied the charges and had taken oaths, the prosecution presented three witnesses and heard their testimonies.

 

The court, after examining the witnesses and noting that the prosecution had proved the charges against them, unanimously ruled that they should defend only one count.

 

As for the second count, which was based on a false document, the court explained that there were provisions that could be interpreted in the first count and that they could be punished together, and dismissed the second count and ruled that they should defend only one count of corruption by gross fraud.

 

However, in its ruling, it was noted that the defendants failed to properly refute the prosecution's evidence.

 

The 1st defendant, Qesis Belay Mekonnen, was found guilty by a unanimous vote, while the 2nd and 3rd defendants were found guilty by a majority vote of one judge.

 

The one judge who dissented expressed his disagreement, stating that the mere disclosure of their bank accounts did not constitute a conspiracy to commit the crime.

 

The court, after examining the sentencing opinions of the left and right parties, upheld the sentence proposed by the prosecutor, citing that the crime was committed in collaboration.

 

Accordingly, the 1st defendant, Qesis Belay Mekonnen, was sentenced to 5 years of rigorous imprisonment and a fine of 10,000 birr in accordance with Article 21.

 

Regarding the 2nd and 3rd defendants, the court has decided to sentence them to 3 years and 3 months of rigorous imprisonment and a fine of 3 thousand birr in accordance with Article 17, with four mitigating factors, each.

 

The court has ordered that the rigorous imprisonment imposed on the defendants be implemented from the date of their arrest at Addis Ababa Prison.
