The approved asset recovery proclamation is effective and will only be enforced by court order, giving the suspect an opportunity to appear and explain the case to avoid unreasonable charges.
The Ministry of Justice, which is responsible for implementing the proclamation, gave a briefing to journalists today regarding the asset recovery proclamation approved on January 1.
The proclamation is said to work to protect the country and public assets from crime by properly recovering illegally obtained assets.
Justice Minister Hana Arayasalassie, who issued the proclamation, said that although the Ministry of Justice is responsible for implementing the asset recovery proclamation, it is not implemented arbitrarily but only based on a court decision.
However, if irreparable damage, such as the property being stolen from the country and other similar damage, is caused, the Minister said that a temporary ban will be issued by the Ministry of Justice itself without a court order.
It is said that if an individual acquires property in good faith without knowing that it is illegal, the property will be protected from confiscation.
The Minister also mentioned that there is a guideline in the proclamation that allows a person suspected of acquiring illegal property to prove that he is not guilty through evidence that he has not received it or through other people.
The Minister also mentioned that the proclamation is being implemented in cooperation with various countries, and that if it is proven that the property was acquired illegally in foreign countries, even if it is in Ethiopia, it will be returned.
Another aspect of the proclamation is that the property will not be returned based on guilt, which is that if the suspect dies or flees the country, the property will not be left as is, but will be frozen and the case will be investigated and the person will be confiscated in his absence.
The Ministry of Justice stated that the main purpose of the Asset Recovery Proclamation is to protect citizens who have acquired their assets legally and through hard work, by preventing those who have committed economic crimes and have caused damage by using their assets.
